Frequently Asked Questions

How long does the adoption process take in Ontario?

The timeline varies depending on the type of adoption. Private adoptions can take several months to over a year, depending on the circumstances. International adoptions often take one to three years or longer, depending on the country. Public (CAS) adoptions vary widely based on the availability of children and the matching process.

Do I need a lawyer for a private adoption?

Yes. In Ontario, all parties to a private adoption are strongly encouraged to have independent legal advice. A lawyer ensures that consent is properly obtained, that the home study and court application are completed correctly, and that your rights are protected throughout the process.

Can single individuals adopt in Ontario?

Yes. Ontario law permits single individuals to adopt through private, public, or international adoption. The eligibility requirements are the same as for couples.

What is the difference between a surrogacy agreement and a parentage declaration?

A surrogacy agreement is a contract between the intended parents and the surrogate that outlines the terms of the surrogacy arrangement. A parentage declaration is a court order that legally establishes the intended parents as the child’s legal parents. Both are typically required in a surrogacy arrangement.

Is commercial surrogacy legal in Canada?

No. Section 6 of the Assisted Human Reproduction Act prohibits paying a surrogate mother for acting as a surrogate. Only altruistic surrogacy is permitted, though intended parents may reimburse the surrogate for reasonable expenses.

Can LGBTQ+ couples adopt in Ontario?

Absolutely. Ontario law provides equal adoption rights to all individuals and couples regardless of sexual orientation or gender identity. Same-sex couples can adopt jointly through private, public, or international adoption.

What is a second-parent adoption?

A second-parent adoption allows a non-biological parent in a same-sex or other relationship to legally adopt their partner’s child without the biological parent giving up their parental rights. This creates a legal parent-child relationship between the child and both parents.
