Duration of Spousal Support
The SSAG provide formulas for calculating support duration:
Without Children (Length of Relationship Formula): Support ranges from 0.5 to 1 year for each year of the relationship. For relationships of 20+ years, support may be indefinite.
With Children (Custodial Payor Formula): Duration is generally longer to account for the impact of childcare responsibilities on the recipient’s earning capacity.
The “Rule of 65”: If the recipient’s age at separation plus the length of the relationship equals or exceeds 65, support may be indefinite regardless of other factors.

Tax Implications of Spousal Support
Spousal support payments have important tax consequences in Canada:
- Periodic payments (monthly) are taxable income for the recipient and tax-deductible for the payor
- Lump sum payments are generally NOT taxable or deductible
- Child support, by contrast, is neither taxable nor deductible
Understanding these tax implications is essential when negotiating spousal support amounts, as the after-tax impact can significantly differ from the gross amount.
Frequently Asked Questions
Am I entitled to spousal support in Ontario?
Entitlement depends on your specific circumstances, including the length of relationship, income disparity, roles during the relationship, and your ability to become self-sufficient. A family lawyer can assess your situation and advise on your likelihood of receiving support.
How much spousal support will I receive or pay?
The Spousal Support Advisory Guidelines provide a range based on income difference and relationship length. The actual amount depends on many factors and is determined by negotiation or court order. A lawyer can provide an estimate based on your specific circumstances.
How long does spousal support last?
Duration depends on the length of the relationship and whether there are children. Short marriages may result in support for a few years, while long marriages (20+ years) may result in indefinite support. The “rule of 65” also applies.
Does remarriage affect spousal support?
The recipient’s remarriage or new common law relationship may be grounds for reducing or terminating spousal support, though it does not automatically end it. Each case is assessed individually.
Can I negotiate spousal support in a separation agreement?
Yes. Many couples negotiate spousal support terms as part of a separation agreement. Having independent legal advice is essential to ensure the agreement is fair and enforceable.
